HOA#1 Architectural & Landscaping Requirements and Guidelines

 

ARTICLE I  -  GENERAL INFORMATION

 

1.      Introduction

SaddleBrooke is one of the most attractive adult communities in Arizona.  In the interest of maintaining homeowner landscaping and architectural changes in harmony with the overall theme and aesthetic beauty of the community and the surrounding Sonoran Desert environment, the Board of Directors and the Architectural & Landscaping Committee (ALC) have a responsibility to maintain and administer the Architectural & Landscaping Requirements and Guidelines (Guidelines).  These Guidelines are intended to protect the community in a way that does not thwart the creativity and needs of the individual homeowner.  Compliance with these Guidelines supports the goal of maintaining our beautiful and unique community.  

 

Nothing contained herein shall be construed as altering, amending or changing the Declaration of Covenants, Conditions, and Restrictions (hereinafter called the CC&R’s), as recorded with the County of Pinal, or the Articles of Incorporation and Bylaws of the SaddleBrooke Homeowners’ Association #1 (HOA#1).  In the event of a conflict, the following represents the order of priority:  CC&R’s, Articles, Bylaws, and these Guidelines.  To the extent that any government ordinance, building code or regulation requires a more restrictive standard than that found in these Guidelines or the CC&R’s, the government standards shall prevail.  To the extent that any government ordinance is less restrictive than these Guidelines or the CC&R’s then these Guidelines and CC&R’s shall prevail.

 

Approval by the ALC of any construction, installation, addition, alteration, or other work pursuant to these Guidelines shall not be deemed a waiver of the ALC’s right to withhold approval of any similar construction, installation, addition, alteration or other work subsequently submitted for approval. There may be special or unusual cases in which a homeowner, while in compliance with the Guidelines, might be denied approval by the ALC.  Such cases could concern landscaping, alterations, construction or other modifications that cannot be anticipated nor defined in this documentAll cases of such nature would be unique and judged on their own particular circumstances.

 

These Guidelines and any updates, as approved by the HOA#1 Board of Directors, supersede any prior Guidelines.

 

It is the responsibility of homeowners to make sure they have the most recent copy of the Guidelines.  If you are unsure if you have the most recent copy, please call the Clubhouse at 825-3048 for verification or to obtain a copy.

 

2.   ALC Permits for Landscaping and Construction

A.      It is the responsibility of the homeowner to obtain permits as required from the ALC prior to making any exterior alterations or installing any landscaping, as identified in these Guidelines (see Article IV).  Permit Applications shall be completed, signed and initialed by the homeowner and may be considered for review prior to the closing date on your home.  However, no work may begin prior to ALC approval or until after the closing date.  The current copy of the ALC Permit Application form is available at the Clubhouse.

B.     It is the responsibility of the homeowner and succeeding homeowners to maintain landscaping and construction records and permits.

 

3.   Completion of Landscaping

All homeowners shall fully landscape their property as defined in these Guidelines. All initial landscaping shall be completed within ninety (90) days after the close of escrow.  If the work cannot be completed within the stated time frame, a written request for an extension, with justification, shall be submitted to and approved by the ALC. Initial landscaping which is not completed within the ninety (90) day period will incur enforcement action and penalties as described in Sections 4 and 5 of the Association’s Rules and Regulations.

 

4.      Pinal County Permits

It is the responsibility of the homeowner to obtain all necessary Pinal County permits. Pinal County currently requires a permit for exterior 110 volt electrical installations, natural gas lines buried in the ground, swimming pools, some spa installations, exterior construction alterations, additions and ramadas, etc.  For further information, the Pinal County Building and Safety Department may be contacted in Florence at (520) 866-6442.  No ALC permits will be issued until all required Pinal County permits are obtained and copies are provided to the ALC.

 

5.   Contractor Selection

For their own protection, homeowners should exercise due diligence by selecting a licensed contractor for all landscaping and construction needs. The final responsibility for selecting a contractor is up to each homeowner. The ALC maintains a file of comments from homeowners about their experiences with various contractors, which may be reviewed at the Clubhouse office during normal working hours. Neither the HOA#1 Board of Directors nor the ALC has any authority over any contractor conducting business in SaddleBrooke and is not involved in the licensing of contractors. This function is the responsibility of the ARIZONA REGISTRAR OF CONTRACTORS.   Prior to selecting a contractor, homeowners are urged to check the licensing status and records of any complaints against specific contractors by calling the ARIZONA REGISTRAR OF CONTRACTORS at 628-6345 in Tucson.  The ALC will not intervene on behalf of the homeowner if a problem arises between the homeowner and the contractor.

 

6.      Views

A.                              Homeowners cannot expect views, which exist at the time of purchase, to remain unchanged over time.  Property may eventually be improved upon and landscaping, both on residential lots and common areas, will mature. The use of trees within SaddleBrooke is encouraged.  Tree location, number and species are key considerations in the ALC landscape plan approval process.  Neither the ALC nor HOA#1 shall be under a duty to homeowners to protect views or view expectations.

B.                             Homeowners are responsible for seeing that no shrub, tree, exterior addition to or modification of their property adversely affects their neighbors or the community.

C.                             Although the ALC review and approval process attempts to prevent such situations, neither the ALC nor HOA#1 shall ensure that homeowners’ views will be protected. Should conditions lead to a conflict or dispute between neighbors, the affected parties shall try to resolve the matter. Either party may request, in writing, that the ALC review a property owner’s landscaping or construction plan for prior ALC approval.   After examination of the records, the Committee will notify both the requesting party and the party whose property is being questioned of its findings.   However, neither the ALC nor HOA#1 will be a party to any dispute or litigation that arises between neighbors pursuant to personal property rights out of such view disputes.

D.                             As stated above, trees are essential to the landscaping of SaddleBrooke, both on individual lots and in common areas.  If a homeowner desires that a tree in the common area be pruned or removed, such requests shall be subject to the prevailing policy on tree pruning/removal.

 

 

7. Maintenance of Property

A.                              All homeowners, including those not in full time residence, are responsible for maintaining the appearance of their home and related landscaping so that it contributes to the overall appearance and aesthetic value of the neighborhood and the community.  All lots shall be kept free of weeds and trash, and plants and trees neatly trimmed.  Plants and trees shall not hang over onto neighbor’s property, common areas or onto streets.  Failure to comply will result in action by the ALC and/or the Homeowners’ Association and shall be subject to enforcement procedures in Sections 4 and 5 of the Association’s Rules and Regulations.

B.                             Garbage and trash shall be kept in covered containers, stored so they are not visible from the street.  In-ground trash containers are not permitted.

 

8.      Voice Mail Questions

Homeowners are encouraged to call the ALC Voice Mail at (520) 825-3048 during normal Clubhouse office hours with any questions they may have concerning these Guidelines.

 

 

 

 

ARTICLE II  -  ARCHITECTURAL AND LANDSCAPING STANDARDS AND REQUIREMENTS

 

 

1.      Architectural Standards and Requirements

A.      The design, style, detailing, materials and color of structural and/or hard-wall additions or exterior renovations, i.e. casitas, room additions, garage additions, golf cart garages, or equal, shall conform to that of the original home.  

B.     All additions to the original home require an ALC permit and shall be built within the setback and building envelope (if any) lines originally established for SaddleBrooke, regardless of more lenient requirements of any governmental authority.  The setback and building envelope (if any) lines are shown on the original plot plan provided by the Developer at time of purchase.  Variances to the building envelope requirement will be considered by the ALC on an individual basis.

C.     The height of any addition to an existing home shall not exceed that of the original roof or parapet line.

D.     All materials used in additions and alterations shall conform to those used by the Developer. The ALC may, at its’ discretion, allow substitute materials that are compatible with the theme of the community.

E.     When any building additions, alterations or renovations are made to an existing home, the lot drainage to the street, as established by the Developer, shall not be altered.  All roofs or gutter installations shall drain to the ground solely within the deeded lot line.  Drainage to common areas is prohibited. 

F.      Pinal County permits are required for most exterior additions and modifications.

 

2.      Landscaping Standards and Requirements

A.                           In planning landscaping and construction, consideration must be given to allow access for the

maintenance of areas that have TV cable, electrical boxes, water meters, fire hydrants, etc.  No plants will be allowed that will hinder utility maintenance personnel or meter readers.  Such plants may be removed by the utility companies. 

B.   The use of native and/or drought tolerant species is strongly recommended for all landscaping.  Water intensive plants should be confined to small areas close to the residence.  (See Appendix A for plant materials and trees that are prohibited in SaddleBrooke).  Compatible community groupings should be taken into consideration to allow for appropriate irrigation system planning.  Drip irrigation is recommended.

C.  Sufficient landscape materials shall be used to maintain harmony with surrounding areas. The minimum requirement of plants for front yards are one (1) fifteen gallon tree or saguaro or organ pipe five feet or taller, and twenty (20) plants of a minimum one-gallon size as approved by the ALC.  The ALC, at its discretion, may require additional plants or grant variances to the number of living plants. There is no minimum planting requirement for side and rear yards.

D.  The ALC reserves the right to limit the number of plants and trees as presented in the plan.

E.  All ground not covered by plantings, including front, side and rear yards, shall be covered with    crushed natural colored rock (3/8 inch to 1 inch) and native river rock.  Two to three inches of ground cover rock is recommended depending on rock size.  No white or artificially colored rock or crushed man-made materials are permitted.  Multiple rock colors used for accent and decorative purposes are limited to two color choices.  Lava rock may be used as an accent.

F.  Road base or foundation base materials (gravel or ABC) and quarter minus (decomposed) granite are prohibited for ground cover.  Decorative uses of quarter minus granite will be considered by the ALC.

G.  Mounds in front and rear yards shall not exceed eighteen (18) inches in height from grade level and shall be constructed of natural materials.

H.  All air conditioners shall be screened from street view. Screening may include a return wall or plantings of sufficient height, density and placement to accomplish the same effect.

I.    Weed growth or other nuisance plant materials shall be controlled with herbicides and/or manual weeding (See Article I, 7).  Plastic sheeting may not be placed under crushed rock for weed control since it is ineffective and causes the covering crushed rock to wash away.

J.  No landscaping or construction materials owned or contracted for by the homeowner may be left on any street for over 48 hours.  All materials encroaching on the street shall be clearly marked with orange traffic cones.

K.  Care shall be used when landscaping along roads or corners to avoid visual obstructions that may compromise the safety of pedestrians, bicycles or other vehicles.

L.  Private landscaping, bird feeders, wild animal feeders or other artifacts are not permitted in Common Areas unless approved by the Board of Directors, and in conformance with Section 7.1 of the Association CC&R's.

 

 

 

ARTICLE III  -  SPECIFIC GUIDELINES AND REQUIREMENTS

 

 

1.      Introduction

Most projects, but not all, that will modify or change the exterior of an HOA#1 home will require a permit from the ALC to complete.  The Board of Directors and the ALC has reviewed all categories of potential projects and has jointly established three separate permit requirement categories.   Basically the “degree of difficulty” of each potential project determines permit requirement and processing needs.  The following summarizes these categories and their permit requirements, if any:

 

A.  No ALC Permit RequiredThe project descriptions included herein are of adequate detail that the intent is clear and abiding by those descriptions should result in a totally compliant project without prior review.

B.  ALC Permit Required/Meeting Attendance Not Required The project descriptions included herein are of adequate detail to make the preparation of a permit application definitive without issues that may require homeowner clarification or ALC input.  Permit application and supporting documentation shall be prepared but may be submitted either at the SaddleBrooke Clubhouse Reception Desk or at the ALC meeting.  In either case, review will occur at the weekly ALC meetings on Thursdays.

C.  ALC Permit Required/Meeting Attendance Required The project descriptions included herein could result in various interpretations of compliance that may require homeowner clarification.  A permit application and supporting documentation shall be prepared and submitted in person by the homeowner or designated representative for review and discussion at the weekly ALC meetings on Thursdays.

 

      It is the intent of the categories identified above to minimize the time obligations of HOA#1 homeowners, and further, to expedite the processing efforts of the ALC.

 

2.      Air Conditioners/Evaporative Coolers – ALC Permit Required/Meeting Attendance Required 

All air conditioning units and/or evaporative coolers installed by homeowners shall be ground mounted on a concrete base.  The top of the unit shall be no higher than forty-eight (48) inches above grade level. All units must be screened from street view by return walls or plantings.  Window units, either permanent or portable, are prohibited from use in any structure, including installation in a window, through a wall or ground mounted.

 

3.   Antennas (Satellite Dish) or Over-the-Air Reception Devices (Wireless Internet Broadband Antennas)No ALC Permit Required (Except for E)

A.  Pursuant to FCC Regulations, the ALC does not require a permit or fee for the installation of one   of these devices.  The ALC does request that the location of each antenna installation be such that it minimizes the antenna’s impact on immediate neighbors.  See Appendix C for preferred mounting locations.

B. Over-the-Air Reception Devices (OTARD) are defined by the FCC as any device used for the reception of video or audio television broadcast signals, Direct Broadcast Satellite services (DBS), or Multi-Channel Multi-Point Distribution Services (MDS), and reception or transmission of fixed wireless communications signals. Any mast, cables, supports, guy wires, conduits, wiring, fasteners, or other accessories for the proper installation, maintenance and use of an antenna shall be considered part of the antenna.  The FCC requires that subscriber antennas shall be labeled to give notice of potential radio frequency safety hazards of these antennas. For two-way fixed Wireless Internet Broadband antennas mounted on a mast, the ALC requires subscriber equipment installation by professional personnel.  Homeowners are cautioned to make sure that antennas attached to a mast are properly grounded, and to be aware of the dangers of lightning strikes inherent to this area.  Homeowners are encouraged to check with their Insurance Agents to verify coverage for lightning strikes to antennas mounted on masts.

C.  Devices shall be one meter (39.4 inches) in diameter or less, and shall be installed solely on the homeowner’s property, not encroaching on adjacent common areas or other homeowner’s property.  Satellite Dishes or other devices, whenever possible, shall be installed in the most unobtrusive manner and shall be shielded from view from other lots, the street, the golf course and common areas, including walking paths, to the maximum extent possible, while still allowing for acceptable quality signal reception. Where possible, it is recommended that the dish be hidden from view through the use of techniques such as artificial rocks, existing landscaping, or by adding reasonable additional landscaping to achieve this goal.

D.  OTARD Authorized Devices (Antennas) – Limit One Antenna per Type of Service

Each residence is limited to one of these devices per type of service, as authorized by the OTARD regulations. Therefore, more than one device per type of service is prohibited.  Should a homeowner install a second antenna for the same type of service, it shall be removed immediately, and the homeowner shall be subject to all applicable fines, fees and penalties set forth in the HOA #1 ALC Guidelines and CC&R’s.

E.   Antenna Masts Over Twelve (12) Feet in Height –ALC Permit Required/Meeting Attendance Not Required

For purposes of safety, any mast supporting an antenna that exceeds twelve (12) feet in height, as measured from the bottom of the mast to the top of the antenna, requires an ALC Permit prior to installation.  The Permit Application shall include a diagram of the device and the proposed antenna or mast, including the following:

1.   An explanation of the means to protect neighbors and/or the community from potential safety hazards, i.e., lightning strikes, high winds, etc.

2.   The lowest possible mast height required to receive point-to-point reception.

3.   The first two preferences for placement location.  Placement requests shall be at a location least visible from the street, the golf course and from other homeowners.  Prior to approval, all requests for Permits will be reviewed by the ALC with emphasis on the effect to the present and future aesthetic value of the community, including on-site review by the ALC.  Homeowners may not install these devices until receiving an approved Permit and shall immediately move or remove such devices upon notice by the ALC, and these homeowners shall be subject to all applicable fines, fees and penalties set forth in the HOA # 1 ALC Guidelines and the CC&R’s.  The ALC may deny placement not in compliance with ALC requirements or other determination under this paragraph, ALC Guidelines, or the CC&R’s.

F.   Antennas Exceeding One Meter in Diameter and Other Exterior Antennas – NOT ALLOWED

All antennas exceeding one meter (39.4 inches) in diameter, or any other exterior antennas for AM or FM radio, amateur “HAM” radio, Citizen’s Band (CB) radio, Digital Audio Radio Service (DARS) or other signals, are prohibited.

G.  Maintenance

Homeowners are responsible for the maintenance and repair of antennas.  Antennas shall not be allowed to fall into disrepair or become safety hazards.

 

4.   Arches – ALC Permit Required/Meeting Attendance Required

A.      Arches adjoining exterior walls shall be stuccoed construction and painted to match the house or adjoining wall.  The maximum clear width of the arch shall be five (5) feet.  The maximum height of the arch construction shall be nine (9) feet above grade level on the side of the arch that is exposed to the public.  Freestanding arches are prohibited.

B.   Front entrance arches (and barrel vaults) adjoining the house and another structure shall be stuccoed construction and shall be painted to match the house.  The minimum clear width of the arch shall be five (5) feet.  The height of the arch construction shall not exceed the height of the house.

C.  Arches may be curved or angular/square, provided the structure is in proportion to the house, blends with the architecture of the house, and is consistent with the overall aesthetics of the neighborhood.

D.  The homeowner is to demonstrate that the design is structurally sound and meets all building codes having jurisdiction over this development.

 

5.   Awnings, Sunshades and Screens – ALC Permit Required/Meeting Attendance Not Required

A.                           Awnings shall be a solid color fabric approximating the color of the house or trim or roof tile.  They may be of a slanted or rounded style.  Supporting parts of fixed window awnings may project no more than four (4) feet from the house.  The awning shall be no more than six (6) inches wider than the window.  Retractable awnings are restricted to the rear of the home and shall be a solid color fabric, again approximating the color of the house, trim or roof tile.

B.                             Exterior Roll-Down Sunshades of metal or composite materials shall be a solid color approximating the color of the house or trim.  Roll-down sunscreens may be black.  Exterior sunshades/sunscreens made of plastic, reed or bamboo are prohibited Exterior roll-down sunshades or sunscreens are limited to the side or rear of the house.  When lowered they shall be secured. 

C.                             Regular exterior window sunscreens do not require an ALC Permit.

D.                          Freestanding sunscreens or netting to shade plantings and/or the erection of privacy structures are prohibited.

 

6.   Barbecues and Grills

A.                           Fixed Barbecues/Grills – ALC Permit Required/Meeting Attendance Required 

Fixed barbecues/grills shall not exceed five (5) feet in height, and are only permitted in rear yards. They may use natural gas or propane.  Natural gas installations require a Pinal County Permit.

B.   Portable Barbecues/Grills - No ALC Permit Required

There are many different types of portable barbecues and grills that may be of natural gas, propane or charcoal type.  Portable barbecues/grills are prohibited in front yards.

 

7.   Bird Feeders and Birdhouses - No ALC Permit Required

Bird feeders and birdhouses may not be more than six (6) feet in height above grade level unless they are hung directly from the eaves of the roof.  They may be placed only in the rear yard of the property and placement in common areas is prohibitedA maximum of two (2) are permitted in each yard to limit the potential of a nuisance to neighboring properties (Spilled seed may attract rodents and snakes).  Hummingbird feeders are not included in this maximum.  

    

8.   Casitas, Guesthouses, Building Additions - ALC Permit Required/Meeting Attendance Required

A.   Casitas, guesthouses, or other rooms shall be of a design and materials similar to the existing residence and harmonious with the neighborhood and community.  The ALC shall have the right to disapprove plans and specifications which the ALC determines are not in accordance with all the provisions of the CC&Rs, or if, in the ALCs opinion, the design, color scheme or location of the proposed structure is not in harmony with the general surroundings and topography of the Lot or with other buildings and structures in the vicinity.  Photographs of the existing structure can be very helpful to the ALC in the review process.

B.   If placed in front of the original dwelling, the rear wall of the casita, guesthouse or addition shall be within fifteen (15) feet of the original structure and shall be within the building setback line as shown on the plot plan from the Developer.  The casita, guesthouse or building addition shall be attached to the original dwelling by either:

1.      A continuous roofline between the two buildings.

2.      A five (5) foot high wall.

3.      An arch with a gate, or

4.      A ramada.

C.  Casitas, guesthouses and building additions are limited to four hundred and fifty (450) square feet in size.  Larger additions will be considered by the ALC based on the project’s scale relative to space available and the size of the existing structure.

D.  A Pinal County Permit is required for the construction of any casita, guesthouse or building addition. Pinal County zoning laws prohibit the inclusion of kitchen facilities in casitas or guesthouses; however, a bar area with a sink and a small under-counter refrigerator is acceptable.

E.  It is recommended that a preliminary sketch be brought to the ALC prior to incurring detailed design costs.

F.   Adjacent neighbors’ written comments shall accompany the application for an ALC permit.

 

9.   Driveway & Walkway Coatings – No ALC Permit Required

The color of driveway or walkway coatings shall match or approximate the color of the house.   Pattern design, if used, should be unobtrusive with the color matching or approximating the color of the house or trim, and shall cover the entire driveway or walkway.  Strips of pattern designs are prohibited.

 

10. Driveway & Walkway Extensions  – ALC Permit Required/Meeting Attendance Not Required

A.   A drawing to scale shall accompany the permit application that shows the location and material type of extension or overlay being added to the driveway, walkway, patio or other existing hardscape.

B.   Homeowners are cautioned that the utility companies have the right to remove any extensions or construction placed within the setback line of the property without reimbursement to the homeowner.

C.  Care shall be taken that underground utility lines are not disturbed when altering driveways or walkways.  Neither the ALC nor HOA#1 shall be responsible for approved driveway/walkway plans that interfere with or disturb underground utility lines.

 

11. Elevated Structures/Decks – ALC Permit Required/Meeting Attendance Required

Detailed plans, drawn to scale, depicting the elevated patio, platform, deck or other structure shall be presented to the ALC for review (see Article IV 3, Plans). The floor height of such structures shall not exceed eight (8) inches above grade and not more than 36 inches above floor level in the house.

 

12. Fences/Pet Pens/Garden Enclosures/ “Critter Fences”

A.  Wrought Iron Fences – ALC Permit Required/Meeting Attendance Required

      Wrought iron fences shall match the style of wrought iron existing in the community and installed by the Developer.  A drawing to scale shall accompany the permit application. Wrought iron fences, which were part of the Developer’s construction on golf course and/or green belt lots, may not be removed.  However, such fences may be reduced to a height of not less than twenty-four (24) inches above grade.  For new wrought iron fences or when raising wrought iron fences in locations along the golf course and common grounds, vinyl or aluminum fencing is an acceptable substitute for wrought iron. Paint color shall be black, dark bronze or the standard wall color (Palo Tofu or equal)Wood, screen, metal screen, chicken wire or chain link fencing is prohibited.

B.  Pet Pens/Garden Enclosures – No ALC Permit Required

      Dog/pet pens, garden enclosures, and other similar installations shall not be visible from the street, the golf course or from neighboring property.  Maximum height of such enclosures is five feet.

 

     C. “Critter Fences” For Wrought Iron Fences and Gates – No ALC  Permit Required

       “Critter” fences can be added to the base or bottom portion of wrought iron fences subject to the following limitations:

       (1) no higher than twenty-four (24) inches,

       (2) shall be constructed only of ½ inch x ½ inch hail screen,

       (3) the colors shall be dark green, black or the color of the wrought iron fence and

       (4) shall be constructed in accordance the details provided in Appendix “D”. Expanded metal lath and chicken wire are prohibited.

 

 

13. Fireplaces (Exterior), Fire Pits, Kivas, Chimineas – ALC Permit Required/Meeting Attendance Required

Exterior fireplaces, beehive fireplaces, kivas, chimineas and fire pits constructed of concrete block or brick shall not exceed five (5) feet in height above grade and may be placed only in rear yards.  They shall be painted to match the color of the house or walls (brick fire pits may remain the natural color).  Portable units do not require an ALC Permit, and may be placed only in rear yards.  A Pinal County Permit is required if gas or electric service is used.

 

14. Flag Poles (Permanent), Flags  & Wind Socks – ALC Permit Required/Meeting Attendance Not Required

A.                              The location of the flagpole shall be at least ten (10) feet from any street curb and from all other lot lines.  The top of the flagpole may be no higher than the highest point of the house and in no case may it exceed twenty (20) feet in height.  Flagpoles shall be either natural silver metal color, dark bronze, black metal, or white fiberglass.  Only one flagpole per lot is allowed.  No flag shall exceed three (3) feet by five (5) feet in size.  No more than two (2) flags or two (2) windsocks can be flown on any property.

B.                             Flags may also be flown temporarily from removable poles attached to the house, and do not require an ALC Permit.  The above flag sizes and number of flags also apply.

 

15. Fountains/Water Features – ALC Permit Required/Meeting Attendance Required

A.                              Permanent fountains and water features may only be installed in rear yards, side yards (based on space available) and front courtyards and may not exceed five (5) feet in height above grade level. (A courtyard is defined as being a space enclosed by existing structure and pony walls on all sides).  Fountain/water feature pumps shall be screened from street and golf course view, and located to minimize noise transmission to adjacent property, and may not be attached to a party wall.

B.                             Portable fountains have the same height requirements as permanent fountains.

C.                             Electrical connections (110 volt) for both fountains and water features require a ground fault interrupter (GFI) outlet, a Pinal County Permit and shall be buried underground.

D.                             Wall fountains are considered yard art and count as one art object toward the total of six (6) allowed per front and street yard area. (Refer to Yard Art, Article III, Section 30).

 

16. Garages, Garage Additions and Modifications – ALC Permit Required/Meeting Attendance Required

A.                              These structures may not be converted for any use other than that for which they were originally intendedGarage roofs and doorframes may not be modified to accommodate motor homes or other large vehicles except for special vehicles for the handicapped.  Driveways and garage floors are not to be lowered.

B.                             Where space permits, garage additions may be constructed but must be within setback requirements.  Garage additions shall be of a design and materials similar to the existing residence and harmonious with the neighborhood and community.  Detailed plans for any additions along with a plot plan shall be presented to the ALC when making the permit application. A Pinal County Permit is also required. Adjacent neighbors’ written comments shall accompany the application for an ALC permit.  Photographs of the existing structure can be very helpful to the ALC in the review process.

 

17. Gates – No ALC Permit Required

      Gates shall be constructed of wrought iron, vinyl or aluminum and may contain metal screening panels on the rear of the gate.  Gates and metal screening panels may be black, dark bronze or match the house or adjoining wall color.  Ornamentation on gates shall be painted to match the color of the gate.  Gates that do not meet this criteria may be submitted to the ALC for consideration.

 

18. Gazebos – ALC Permit Required/Meeting Attendance Required

A.                                                                                                                  A detailed drawing to scale depicting the intended structure shall be provided along with the Permit Application. Gazebos shall be constructed of wood or wood-grain materials.  Construction of gazebos is limited to rear yards only, and must be contained within the setback lines of the property.  A Pinal County Permit may be required.  Adjacent neighbors’ written comments shall accompany the application for an ALC permit.

B.                                                                                                                 Gazebos shall be finished, painted, or stained to match the color of the house or trim. The maximum allowable height of such structures is nine (9) feet above grade level to top of roof.   The roofs of these structures may be constructed of tile matching that used on the house.  Wood shakes or beams or wood-grained materials may also be used.  Wood shakes, beams or wood grained materials shall be painted or finished the same color as the finished structure.

 

19. Golf Ball Nets – ALC Permit Required/Meeting Attendance Required

A.                                                                                    Comments from affected neighbors, including those located across from and to each side of the proposed net, shall be submitted to the ALC with the permit application.  Posts to support the net may be no taller than twenty (20) feet above the grade level and painted black or dark bronze.  The netting shall be of a see-through non-metallic material.

B.                                                                                   No guy wires may extend outside the lot lines of the property upon which the net is erected.

C.                                                                                   The net, poles and guy wires shall be maintained and kept in good condition and not allowed to fall into disrepair.

 

 

20. Grass – No ALC Permit Required

While natural grass or sod is not recommended due to high water usage, the ALC allows the use of low pollen producing non-allergenic types of grasses in small areas in rear yards.  Artificial grass used for decorative purposes or putting greens is permitted in rear and side (if space available) yards only.

 

21. Gutters and Downspouts - No ALC Permit Required

A.                                                                                                                  An ALC Permit is not required to have gutters and downspouts installed. However, the gutters and downspouts shall match or approximate the house or trim color. Runoff may not be diverted to another property or common area.

B.                                                                                                                 Sealing of the edges of any patio roof covers, in conjunction with gutter installation, shall match the color of the patio cover. 

C.                                                                                                                 When gutter installation also includes fascia board, colors shall match or approximate the existing surface to which it is being applied.

 

22. House Numbers No ALC Permit Required

For safety purposes in case of emergency, Pinal County requires homeowners to place house numbers in a conspicuous place on the front of the home and be large enough to be easily seen from the street.  Emergency organizations prefer 6” black numbers, centered above the garage door. Numbers in script are not recommended.

 

23. Lighting, Exterior – No ALC Permit Required

A.        Exterior Floodlights

The CC&Rs state that exterior lighting must not create a nuisance to neighbors. Security floodlights are only to be used on an intermittent basis and not to illuminate landscaping and/or patios.  

B.   Exterior Post Lights

A post light located in the front yard shall be a minimum of eighteen (18) inches from the edge of the street curb.  The maximum allowable height for any such light is seventy-two (72) inches.  The maximum combined wattage of the bulbs is thirty (30) watts.  The light pole shall be painted black, dark bronze or the same color as the house or trim.  The light fixture on the top of the pole may be black, brass, dark bronze or the color of the house or trim.  Post lights may also be mounted on pony walls in front yards. The same rules apply for the color of the light fixture and maximum wattage, with a height limitation of fifty-four (54) inches from grade level to the top of the fixture. 

C.  Low Voltage Lighting

   Installation of low voltage lighting along walkways, driveways and around patios is permitted.  Tree and other mood lighting directed upward should not create an undue glare to neighbors and/or towards the street.

D.  Garage Front/Front Entry Lights

Color and style should be consistent with house architecture and community theme. 

E.   Bug Lights/Zappers

      Bug lights/zappers may not be located more than six (6) feet above grade unless they are hung directly from the eaves of the roof.  If hung from the eaves, every effort shall be made to avoid creating a glare or light source that invades neighboring properties.  No more than two (2) bug light/zappers will be permitted and then only in the rear of the property.

 

24. Mailboxes/Tubes No ALC Permit Required

Mailboxes shall be standard #1 size, black mailbox, approved by the U.S. Postal Department.  Decorative or novelty mailboxes are prohibitedTemporary holiday decoration of mailboxes is permitted.  The homeowner is responsible for maintaining the post, mailbox and tube in good condition and painted black.

 

25. Painting, Exterior

A.      Other Than Original Color – ALC Permit Required/Meeting Attendance Not Required

      Prior to painting the exterior, trim, doors, the interior or exterior of party walls or return walls of a home any color other than the original color, an ALC Permit is required.  All colors shall be those currently in use, with minor exceptions, in HOA#1. Some color samples are available at the ALC.  When a new color is proposed, a color sample shall be submitted with the permit application.

B.     Same as Original Color – No ALC Permit Required

      When the proposed painting is the same as the original color, no ALC notification is required.  The single exception to this is on homes that have wood covered end gables instead of stucco.  On such homes the developer originally painted these wood sections the same as the trim color.  When homes with this gable end construction are repainted, these wood covered end gables shall be painted the same color as the stucco walls.  The intent of this change is to establish aesthetic uniformity with the vast majority of HOA#1 homes.

C.       Entry Door Other Than Original Color – ALC Permit Required/Meeting Attendance Not Required

      The ALC may, at its discretion, approve accent colors for front entry doors only. The style of architecture and the visibility of the door will be considered in rendering a decision.

 

26. Planters – ALC Permit Required/Meeting Attendance Not Required

Planters may be constructed in front, side and rear yards provided the height does not exceed eighteen (18) inches, and they do not intrude into the utility easement.  Planter stacking may not exceed a maximum height of thirty-six (36) inches.  Planters that are against a party/perimeter wall shall be water proofed on all sides to prevent leakage and paint peeling.  Planters shall be constructed of concrete block, stuccoed and painted to match the wall or house color, or of brick, or a natural stone of a color compatible with the rock ground cover being used.  The planter design and location shall be shown on a plot plan.

27. Ramadas/Latillas/Porch Covers – ALC Permit Required/Meeting Attendance Required

A.        Freestanding Ramadas/Latillas

1.         A detailed drawing to scale depicting the intended structure shall be included with the Permit Application.  Such structures shall be constructed of wood or aluminum wood grain materials.  Construction is limited to rear and side yards only.  Wood latillas are recommended for use with homes of the Santa Fe elevation only.

2.         The structure shall be painted or stained and shall match the color of the house or trim.  The maximum allowable height of such structures is eight feet six inches (8’-6”) above grade level measured to the top of the rooftopUmbrella-type ramadas are prohibited.

3.         Freestanding ramadas/latillas shall be constructed within the setback lines, as shown on the plot plan.  A Pinal County Permit may be required for the construction of a freestanding ramada/latilla.

4.         Permit Applications for the above structures shall be accompanied by the written comments of affected neighbors.

B.        Attached Ramadas and Porch Covers

1.         A detailed drawing to scale shall be included with the Permit Application.  Construction of such structures is limited to rear and side yards only. They shall be constructed of wood or aluminum wood-grained materials and finished or painted to match the color of the house or its trim. The maximum allowable height of such structures shall not exceed the height of the Developer-installed patio cover.

2.   Permit applications for the above structures shall be accompanied by the written comments of affected neighbors.

 

28. Roof Coatings/Tiles

A.   Roof Coatings – No ALC Permit Required

      As of October 2001 white roof coatings are prohibited on any roof, including flat roofs and patio covers.  Desert tan is the designated color for these areas

B.   Roof Tiles ALC Permit Required/Meeting Attendance Required

      Any change in the color of roof tile requires an ALC Permit.

 

29.   Screen Doors/ Security Doors – ALC Permit Required

       Attendance Not Required for B.

   A. Screen/security doors and panels that are installed within the frames of existing doors, sidelights and transoms do not require an ALC permit.

   B. Screen/security doors and side panels that enclose an entryway, porch or patio do require an ALC permit.

  In either case the screen/security doors shall be constructed of wrought iron and shall be limited to one of the following colors:

            1.   Same color as exterior door, when exterior door is painted, or

            2.   Same color as house color or trim color, or

            3.   Same color as window inserts, or

            4. Black or dark bronze.

30. Screened Rear Patio Enclosures – ALC Permit Required/Meeting Attendance Required

Screened rear patio enclosures shall be constructed of materials equal to those used by the Developer.  All door frames and screen mullions shall be structural aluminum.  The door frames/mullions and screen material shall be the same color as the existing window frames/screens.

32. Solar Panels, Skylights and Collectors – ALC Permit Required/Meeting Attendance Required

A.   A Pinal County Permit is required for the installation of solar collectors and ancillary equipment.  The installer shall be a licensed solar contractor with the appropriate contractor’s license. 

B.  Solar collectors should be flush-mounted and centered on the patio roof if sufficient space is available, or if possible, the patio roof should be extended. If another placement location is necessary, the ALC must approve the preferred location, considering ground-mounted solar collectors, centering on the plane of the roof to the rear or to the side of the house, or “Z-Bar” frame, as usual preferred order.  All exterior plumbing lines shall be painted to match the color of adjacent roof material and walls.  Aluminum trim, if used and visible, should be anodized or otherwise color treated to blend into the surroundings as much as possible.

C.  An illustrated brochure of the proposed solar unit, which depicts the materials to be used, and drawings showing the location and number of collectors, the attachment to the roof structure, and the location of exterior system components, shall be submitted with the Permit Application.  Ground-mounted solar collectors shall be within the setback lines and concealed from neighbor’s view to the extent possible.  All installations shall meet the applicable fire, safety and building codes. 

D.  Homeowners are urged to check with SaddleBrooke Construction Customer Service prior to installation for impacts on their roof warranty.  Neither the ALC nor the HOA#1 Board of Directors is liable to the property owners from roof damage or for effects to roof warranties.

E.  Solar tube skylights do not require an ALC Permit.  However, homeowners should be aware that such installations might affect their roof warranty. 

 

 

 

33. Spas and Swimming Pools – ALC Permit Required/Meeting Attendance Required

A.  All pools and spas shall be installed according to Pinal County ordinances, and require a Pinal County Permit.  Pinal County requires safety fences that must be five (5) feet in height and must have self-closing and latching gates and doors.  Prefabricated spas may not exceed 3’-6” (42 inches) in height and must have locking covers.  An in-ground spa, or any spa which exceeds eight (8) feet in any dimension, is subject to the Pinal County Ordinances regulating swimming pool fences.

B.     Pool pumps shall be screened from street and golf course view. The recommended screening is cement block walls enclosing the pump. Screening structures shall be painted the same color as the house.

C.     Every attempt shall be made to minimize noise transmission to adjacent property stemming from pool/spa pumps.  These pumps should be located as far as possible from neighboring property and cannot be attached to a party wall. 

D.     Above ground pools are prohibited. 

 

 

 

 

34. Storage Containers – No ALC Permit Required

A.        One (1) rubber/plastic type storage container is permitted, but cannot exceed a height of 48 inches.  Storage containers shall be concealed from view of the street, golf course and neighboring property. 

B.        Storage sheds are prohibited in accordance with Section 2.3 of the CC&R’s.

 

35. Tiles, Exterior – ALC Permit Required/Meeting Attendance Required

    Ceramic tiles are permitted on pony walls and on stairways in front yards.  Ceramic tiles around doors or windows in front yards or on house or front walls that are visible from the street are discouraged.  Artistic presentations will be considered by the ALC.

 

36. Trees – ALC Permit Required/Meeting Attendance Required

An ALC Permit is required to add or relocate any tree on a lot. Adjacent neighbors’ written comments shall accompany the application for an ALC permit.  “Volunteer” trees that sprout from seeds shall be approved for type and location. 

 

37. Trellises  & Lattice Panels

A.   Plant Trellises and Lattice Panels – No ALC Permit Required

      Trellises and lattice panels may be used to support plant material.  The panels or trellises shall be securely attached to the house or wall and shall be painted to match the house or wall color.  Wrought iron trellises shall be painted black, dark bronze or the color of the house or wall.  Freestanding trellises, lattice panels, archways and arbors are prohibited.

B. Screening Trellises and Lattice Panels – ALC Permit Required/Meeting Attendance Not Required

      Lattice panels that are used to provide screening and thus change the architectural design of a home require an ALC permit.

 

38. Walls – ALC Permit Required/Meeting Attendance Required

A.   Definitions:

1.   Party wall shall mean a wall constructed on the property line between lots.

2.   Return walls are those that connect a party wall or perimeter wall to the residence.

3.   Perimeter walls are the walls constructed on the property line between private homeowner lots and common areas.

4.   “Pony” walls or seat walls are decorative and constructed with-in the limits of a homeowner’s property lines.

5.   Retaining walls are those constructed along a slope in order to hold back or support the earth in the slope.

B.   Guidelines:

1.                  No alterations to existing walls shall be made without an ALC Permit.

2.      Party walls shall be masonry, wrought iron, aluminum or vinyl of the type installed by the Developer, and they cannot extend beyond the farthest point of the front of the original structure.  They shall be painted on both sides by the homeowner erecting or altering the wall.  Murals painted on party walls visible from the street or neighboring property and painted wood, chain link fencing or other types of materials are prohibited.  

3.      Return walls shall be masonry, wrought iron or vinyl of the type installed by the Developer  and cannot extend beyond the farthest point of the original structure.  Masonry return walls shall be painted on both sides and stuccoed on the side facing the street by the homeowner erecting or altering the wall.  Painted wood, chain link fencing, metal screening or other types of materials for return walls are prohibited.

4.      Masonry used to raise party walls or return walls shall match the type and size of existing masonry used by the Developer for constructing walls and shall be painted/stuccoed to match the existing walls on both sides.

5.      Proposed additions to raise or modify party walls require the written agreement of all homeowners sharing the party wall property line.  If SaddleBrooke Development Company owns the adjoining lot(s), a letter of agreement must be obtained from an RCI representative to raise or modify the party walls.  Such agreements shall be obtained prior to applying for an ALC Permit and shall accompany the Permit Application.  Additionally, if a county permit is required a copy must be provided.

6.      Proposed additions to raise or modify perimeter walls may require a signed “Perimeter Walls” form where the homeowner accepts full responsibility for any future structural failures.  Additionally, if a county permit is required a copy must be provided.

7.   The total height of walls should not exceed seven (7) courses of block.  The footings installed by the developer are not intended to support more courses.  The height of walls shall be measured from the finished grade elevation on the highest-grade side of the subject wall. 

8.   Decorative or “pony” walls may extend no more than the greater of five(5) feet or twenty-five percent(25%) of the distance forward from that part of     the house or garage closest to the street to the inside of the curb line of the street. As per Section 38(A) 4 above, the wall(s) shall be constructed with-in the limits of the homeowner's property lines. Walls that extend five (5) feet or less forward from the house or garage shall not be more than forty-eight (48) inches in height above grade, as measured from the street side, including any pilasters. Walls that extend beyond five (5) feet shall not be more than thirty-six (36) inches in height above grade, as measured from the street side, including any pilasters. The acceptable method of construction is concrete block, finished with stucco, and painted to match the house, and may contain a brick or flagstone cap.  Adobe brick, kiln-dried brick or slump block may also be used.

9.   Lots backing to the golf course and selected lots in Unit 12 (Lots 80 & 81) and Unit 21 (Lots 1-4, 28-35, 114-121, 136-145, & 158-165) may only use wrought iron, aluminum or vinyl fencing of the type installed by the Developer when raising the perimeter wall. The wrought iron, aluminum or vinyl fencing may be painted black, dark bronze or the color of the perimeter wall.

10.    Maximum height of wrought iron fences is six (6) feet, measured from the ground.

11.    Retaining walls four (4) feet or more in height require a Pinal County Permit. However, walls less than four feet in height may require structural engineering.  The ALC will consider each request based upon its own merits and may require additional information.

 

39. Weather recording Equipment – No ALC Permit Required

Weather recording equipment and/or weather vanes shall not be placed over five feet above grade. 

 

40. Yard Art/Wall Art – No ALC Permit Required

A.  Yard art/wall art in front yards shall be consistent with the Sonoran Desert environment and is limited to six pieces (for examples, see Appendix B). Statues, depictions, artifacts and other man-made objects that do not meet this requirement are prohibited.

B.  Yard art that is judged by the ALC to be non-conforming shall be moved to the rear yard, and not be visible from neighboring property.  

C.  Art displayed on the walls of houses shall be consistent with the Sonoran Desert theme.

 

 

 

 

 

ARTICLE IV  -  ALC REVIEW REQUIREMENTS

 

1. Overview


 

 

The ALC monitors and guides the environmental development of SaddleBrooke HOA#1 through a formal review of the homeowners’ landscape and architectural plans and an on-site review program after completion of work. This process assures continuation of the standards of excellence established by the Developer and subsequently by individual homeowners and helps to protect property values within the community.

 

2.      Permit Application Process

      In order to ensure timely ALC review, the following procedures shall be followed:

A.        An ALC Permit Application form, available at the Clubhouse, shall be completed in full by the homeowner (printed or typed) and presented for review, along with any supporting documents, including Pinal County Permits, to the ALC through the clubhouse reception desk or at a regular ALC weekly meeting.  The ALC meets every Thursday from 9:00 to 10:00 AM at the Activity Center (Samaniego Dr. and Galveston Ln.). The Permit Application shall contain the date, signature and initials of the homeowner. 

B.        A copy of the developer’s plot plan shall be included for all construction projects, including ramadas and gazebos, showing the placement of the structure on the plot plan.  Structures must not encroach on the setback lines as shown on the plot plan. Plot plans are available through the construction office.

C.  Neighbor Comments.

1.   It is the responsibility of the applicant to obtain written comments from the affected neighbors using the Neighbor Comment Form available at the SaddleBrooke Clubhouse office or from the ALC.  The completed form or forms shall be submitted or received by or at the time of permit application for casitas, ramadas, gazebos, room additions, garage additions, trees and golf ball nets.  Each affected neighbor must be provided adequate information regarding the proposed project.  Plans, photographs or catalog information are suggested.

2.   The applicant must make a reasonable effort to contact an affected neighbor not currently living in SaddleBrooke.  If no comments are received within fourteen days, and the ALC is satisfied that the applicant made a reasonable effort to contact and inform the neighbor or neighbors, the project will be considered without one or more neighbor comments.

3.   If the affected neighbor refuses to make comments, the applicant will be requested to confirm that in writing.  The project will be considered without one or more neighbor comments.

4.   Neighbor comments that do not support the proposed project will be considered by the ALC, however the project may be approved and a permit issued if the ALC determines the project conforms to these Guidelines and the CC&Rs.  The permit applicant is urged to discuss negative comments with the neighbor and reach a possible compromise.

D.  The ALC has the absolute right to return any application as incomplete, should the application not be accompanied by the required supporting documents.
